Dear Charley:1 All the recommendations made to me for appointments in the Federal Courts come through the Attorney General. I charge the Attorney General with investigating the record, professional standing, character and connections of every possible candidate, and thereafter make the choice of the man who appears to be best suited for the job.2 One of the important features is invariably the recommendation of the American Bar Association.

Consequently, I have turned your letter over to Attorney General Brownell who will give to Governor Arn's case very thorough and exhausting consideration.3

That is all I can promise, as I am sure you will understand.4

It was good to hear from you. I hope that you are well. Remember me to your children when you write to them, and especially to Maude Hurd when next you see her. Of course you will also run into some of my friends around town, like Sam Heller and Emmett Graham and others--give them my best.5

3 Case had written Eisenhower on March 22, 1957, to recommend the appointment of former Kansas governor (1951 - 1955) Edward F. Arn to an anticipated opening on the Tenth U.S. Circuit Court of Appeals (AWF/A Brownell Corr.). Arn, a Republican who was now practicing law in Topeka, had written to Eisenhower on March 23 to express his interest in the judicial vacancy; see Eisenhower to Arn, Mar. 28, 1957, AWF/D. For background see Galambos and van Ee, The Middle Way, no. 1160.

4 Eisenhower would send Attorney General Brownell a note on March 25 (AWF/A, Brownell Corr.) stating that "Mr. Case is a very old & fine friend--but I do not know how much he appreciates the qualifications of a Fed. Judge." For further developments see no. 299.

5 Sam Raymond Heller and Emmett Schwedner Graham, friends of Eisenhower from Abilene, had also written in support of Arn's judicial appointment. Their letters of March 28 and April 1,1957, are in AWF/D. For background on Heller see no. 59. Graham was secretary of the Eisenhower Foundation (see Galambos and van Ee, The Middle Way, no. 47). Maud Rogers Hurd was also a long-time friend of Eisenhower from Abilene (see Eisenhower Papers, vols. I - XVII).
